1. SCOPE/APPLICATION: This privacy policy only applies to FilmBreak and persons or entities that it owns, manages or otherwise controls. FilmBreak does not and cannot speak for companies or people that it does not own or control. This Privacy Policy is intended to supplement and work in conjunction with FilmBreak’s “Universal Terms of Service,” which are available at: http://www.filmbreak.com/terms-and-conditions.

2. DEFINITIONS: Unless otherwise specified, any capitalized words shall retain whatever meanings were assigned to them in the above-referenced Universal Terms.

3. WHAT INFORMATION IS COLLECTED: To use any Services, including without limitation the Website, or to otherwise conduct business with FilmBreak, you may be asked to provide some basic information, some of which may be personal to you. “Personal” information means details about you that are personally identifiable and may not be otherwise publicly available, such as your full name, your home, mailing or office address, e-mail address, telephone number, fax number or other information. Information may also be collected from you that is not “personal” in nature, such as the type of Internet browser and operating system you are using, your Internet Protocol ("IP") and/or the Media Access Control ("MAC") address of your computer, the name of your Internet Service Provider, certain software and hardware attributes, the names and URLs for any websites that you came into the FilmBreak Website from or left it to go to, your ZIP/postal code, your occupation, gender, and approximate age range and other information.

HOW INFORMATION IS USED: FilmBreak uses personal information in relation to the manner in which you interact with FilmBreak, such as by processing transactions, accounting, issuing notifications and changes to Terms and FilmBreak’s official policies (such as this Privacy Policy) and other uses. Some personal information is made public (such as, for example, your bio and certain contact information associated with your FilmBreak account, should you so designate it) while other information is not (for instance, any credit card or bank account information you provide). From time to time, FilmBreak may use personal information to send you communications about the Services and/or changes to its Terms. It may also use such information to customize, improve and enhance its Services and your user experience. FilmBreak uses the non-personal information for a variety of purposes, including without limitation load/network traffic balancing, evaluating users' electronic browsing activities in the aggregate, gathering aggregated demographic information to improve the design, operability and reliability of the Services. 5. COOKIES: FilmBreak may also, from time to time, set and access "cookies" and similar preference-preservation software on your computer. Please be advised, however, that certain aspects of the Services may not be available or may not provide the same level of interactivity and customization if these tools are disabled.

INFORMATION SHARING WITH THIRD PARTIES: FilmBreak limits access to your personal information wherever possible to only those partners, affiliates, employees, attorneys or agents who we believe have a reasonable and legitimate need to know the information to provide certain Services to you. FilmBreak neither sells, rents, licenses, loans nor otherwise distributes any personally-identifiable information about any of its users to third parties. We may, however, share information about you (personal or otherwise) in order to:

• Establish or exercise legal rights or defend against legal claims;

THIRD PARTY LINKS: The Services, including without limitation the Website, may contain links to other destinations on the Internet whose privacy practices may be different from FilmBreak's and that have varying scopes of coverage. You are encouraged to carefully review the privacy policies of every site that you visit. FilmBreak has no control over any information (personal or otherwise) that you submit to third party sites.

8. CHILDREN'S PRIVACY: The Website is not directed at or intended to be viewed by children under 13 years of age. If you are a parent and do not want Your child to have access to the Website or any materials or information found thereto, you should block access using components found either within your browser or in commercially-available blocking software. In any event, pursuant to the requirements of the Children's Online Privacy Protection Act (“COPPA”) of 1998, FilmBreak will not knowingly collect personally identifiable information from children under the age of 13 without first obtaining parental consent, and to the extent such information is inadvertently collected, FilmBreak will make every commercially reasonable effort to obtain permission from a parent or, at its option, permanently delete the information from its records and systems once it has actual knowledge of such collection. Children should always get permission from their parents before providing any information about themselves (including without limitation first and last names, home addresses, e-mail addresses, telephone numbers and dates of birth) to others via the Internet.

9. SECURITY: FilmBreak has implemented physical, electronic, and procedural safeguards that protect your information (personal or otherwise). Although we take these measures to protect against unauthorized disclosures of information, due to the nature of the Internet and electronic communications generally, FilmBreak does not and cannot guarantee that such information will never be disclosed in a manner inconsistent with these Terms.
